These additional terms apply together with the common Terms of Service. In the event of a conflict between the common Terms of Service and these additional terms, these additional terms shall prevail.
BidAlert is a service that collects tender and procurement information published by public agencies and notifies customers of opportunities matching their configured criteria.
1. The Company makes best efforts regarding the accuracy, completeness, and timeliness of tender information but does not guarantee it.
2. Decisions to participate in a tender must be made at the customer's own responsibility after confirming official sources. The Company bears no liability whatsoever for tender outcomes based on information from this Service.
Notifications may be delayed or missed due to system failures, communication failures, delayed updates from information sources, and similar causes. The Company bears no liability for damages arising from delayed or missed notifications.
1. Under the success-fee plan, if a user wins a bid using tender information distributed by the Company, the user shall pay the Company a success fee (exclusive of consumption tax), calculated by applying the following rates according to the winning bid amount.
(1) Portion of the winning bid amount up to ¥50 million: 5%
(2) Portion of the winning bid amount exceeding ¥50 million and up to ¥100 million: 3%
(3) Portion of the winning bid amount exceeding ¥100 million: 1%
2. The Company does not charge for registration, searching tender information, or use of notifications (alerts).
1. The fixed monthly plan costs ¥300,000 per month (exclusive of consumption tax); under this plan no success fee applies and the Service may be used without limit on the number of uses.
2. Users may switch between the success-fee plan and the fixed monthly plan at any time.
If a user wins a bid using tender information distributed by the Company, the user shall, within 30 days of the bid date, report to the Company — in the manner the Company specifies — the fact of the win, the project name, and the winning bid amount.
Results of tenders conducted by government agencies and similar bodies are published on the Portal Site for Small and Medium Enterprise Government Procurement Information and other official media. The Company may verify a user's reports under the preceding article against such published information.
1. If it is discovered that a user failed to make the report required under the preceding two articles, or made a false report, the user shall pay the Company a surcharge calculated at a rate equal to twice the rate specified in each item of Article 4. This surcharge is not a penalty, but is set as an increased consideration that includes the costs the Company incurs in verifying and investigating the reported content.
2. If the user pays the surcharge under the preceding paragraph, the user may continue using the Service.
3. If the user fails to pay the surcharge under Paragraph 1, the Company may suspend provision of the Service and take other necessary legal action.
Users shall pay the success fees, usage fees, and surcharges specified in this special agreement in the manner the Company specifies.
